Description: Each day there is a headline grabbing news piece involving another cyber-attack resulting in the theft of digital information (e.g., government classified materials, PII and healthcare records, intellectual property, financial information) or the disruption of government and business functions. Nation-states, terrorists, hacktivists, and cyber-criminals are relentless. Companies are told "it's not a matter of if, but when" they will be attacked. Compounding that, international and U.S. federal and state regulators are stepping in with new requirements, mandating companies in all sectors to address cybersecurity with little, if any, real guidance on how to do so. Despite being a victim of a cyber-attack, a business most likely will still have to defend its actions in claims from government agencies and litigation involving class action and shareholder derivative suits. What to do? In our discussion, we will address, in general, the current cybersecurity, national security, and privacy legal and regulatory landscape, and how organizations can best navigate same to successfully protect their business operations, networks, and sensitive data. Featuring: Kevin Powers (Founder and Director, MS in Cybersecurity Policy & Governance Program, Woods College of Advancing Studies; Assistant Professor of the Practice, Boston College Law School; Assistant Professor of the Practice, Business Law & Society Dept., Carroll School of Management), Pedro Lenza (Author and Visiting Scholar, Boston College Law School), Susan Simone Kang (Director, Graduate Legal Education and International Programs, Boston College Law School).

Description: Part of the Rappaport Center for Law & Public Policy Webinar Series. Senior Fellow in Residence Community Address: Jonathan Miller, Legal Director at the Public Rights Project, 2021 Senior Fellow in Residence. The talk focuses on the flaws of the current case-selection model utilized by prosecutors and other enforcement agencies. Many government offices typically pursue a legal case based on a complaint from a resident -- someone with the skills, knowledge, and capacity to avail themselves of the process -- or based on a media report. These modes of case generation are reactive and biased. There is a minimal estimation of the potential impact of a case or investigation at the front end. There are no true methodologies for evaluating options against one another. The talk exposes some of the flaws in the existing system and begin to posit strategies to illuminate a pathway forward for more effective and equitable enforcement.

Description: Rappaport Center Webinar Series: Defunding vs. Reforming the Police: Varying Approaches to Addressing Police Misconduct in the 21st Century. Senior Fellow in Residence Community Address: Ajmel Quereshi, Senior Counsel at NAACP Legal Defense and Educational Fund, 2021 Senior Fellow in Residence. As the nation has become increasingly aware, too often, police officials use unnecessary force when interacting with predominantly Black communities. What makes this recent rash of police killings even more disturbing is that the problem is not new. Rather, each generation has been confronted with police killings which shock the conscience. Furthermore, this problem has persisted despite the efforts of civil rights advocates, policymakers, and legislators to reform police departments. Among other things, they have called for and often implemented improved training and data collection. Yet, many of the departments that continue to be plagued with problems have employed precisely these measures. As a result, in the face of continued problems, some advocates have called for defunding police. Some policymakers, however, question whether this is a realistic solution. The community address will tackle the limitations of police reform and explore whether defunding is a workable approach.
