Title: Towards Equitable Enforcement: Moving Beyond the Squeaky Wheel Problem of a Complaint-Based System

URL: https://www.youtube.com/watch?v=OF6oUzK55wc

Description: Part of the Rappaport Center for Law & Public Policy Webinar Series. Senior Fellow in Residence Community Address: Jonathan Miller, Legal Director at the Public Rights Project, 2021 Senior Fellow in Residence. The talk focuses on the flaws of the current case-selection model utilized by prosecutors and other enforcement agencies. Many government offices typically pursue a legal case based on a complaint from a resident -- someone with the skills, knowledge, and capacity to avail themselves of the process -- or based on a media report. These modes of case generation are reactive and biased. There is a minimal estimation of the potential impact of a case or investigation at the front end. There are no true methodologies for evaluating options against one another. The talk exposes some of the flaws in the existing system and begin to posit strategies to illuminate a pathway forward for more effective and equitable enforcement.

Senator Jones delivered a community address entitled, "The State of American Democracy: A New Three-Lantern Warning in the Old North Church." History teaches of the “Midnight Ride of Paul Revere” and the use of lanterns – one if by land, two if by sea – to alert patriots to the threat of advancing British troops. While America must still confront external challenges, today we have three lanterns lit in the steeple of the Old North Church signaling that the most significant threat to American democracy may be coming from divisions within. Who is today’s Paul Revere and will true patriotic Americans come together to meet this threat?
